The new pro-life strategy leverages a less well-known provision of the Constitution of the United States of America, the supreme law of the land.Let us take a look at Article III, section 2 of this document:
In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.
The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed.
Where is the power to take jurisdiction away from the Supreme Court? The key lies in the end of the first paragraph (emphasis added):
In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.
To this writer, it means: Through a simple majority in both the House and Senate and with the signature of the President (or an 2/3 override of his veto), jurisdiction about life issues can lawfully be taken out of the hands of the Supreme Court and handed back to the States for their respective legislative, judicial and executive branches to deliberate.
If this reading is correct, then searching for these elected officials and or candidates who would initiate and/or support such action and shining light on them to gain exposure becomes paramount.
The first thing that needs to be done, however, is to embed this strategy into the people who would vote and/or run for office. Tuesday, January 22, 2008 could be the ideal date to expose people to this strategy. Read on to find out why…
